Terms and Conditions

Welcome to TalentSync, a subscription-based recruitment service provided by TriStarr Staffing. These Terms and Conditions ("Terms") govern your access to and use of TalentSync services (the "Service") for business purposes within the United States.

1. Acceptance of Terms

By subscribing to or using TalentSync, you agree to these Terms, our Privacy Policy, and any applicable service agreements or order forms.

2. Eligibility and Use

  • The Service is intended for business use only within the United States.
  • You must be authorized to act on behalf of a business or organization.
  • You agree not to use the Service for any illegal, discriminatory, or misleading purpose.

3. Service Description

TalentSync provides AI-enhanced job advertisement creation, multi-channel distribution, automated candidate screening, and recruiter-verified candidate delivery on a subscription basis. TalentSync utilizes automated decision-making tools.

You understand that:

  • TalentSync exits the process once candidates are delivered.
  • TalentSync does not guarantee candidate hiring outcomes.
  • You acknowledge that TalentSync is a screening aid only.
  • You, the user, are responsible for final hiring decisions.
  • You, the user, assume all regulatory and compliance responsibility.
  • EEOC compliance is the explicit responsibility of the user.
  • You, the user, agree to indemnify and hold harmless TalentSync and TriStarr Services of Pennsylvania, Inc. for any discriminatory job postings.
  • You, the user, warrant that all postings comply with applicable federal, state, and local laws.
  • You, the client, agree to assume ADA accommodation responsibilities.

4. Subscription and Billing

  • Subscriptions are billed monthly per position at the rate specified in your order (Starter, Core, or Premium tiers).
  • Services are pay-as-you-go. There are no placement fees or long-term contracts.
  • You may cancel at any time, but no refunds will be issued for unused service periods.

5. Client Responsibilities

You agree to:

  • Provide accurate job descriptions and hiring requirements.
  • Respond to candidate submissions in a timely manner.
  • Not use candidate data for purposes outside of employment consideration.

6. Prohibited Conduct

Clients may not:

  • Use TalentSync for roles outside the United States.
  • Share or resell TalentSync outputs to third parties.
  • Attempt to reverse-engineer or misuse the AI systems involved.

7. Data Usage & Privacy

  • Candidate data is used solely for recruitment purposes.
  • All candidate information is confidential and may not be shared beyond your hiring team.
  • You agree to comply with applicable employment and privacy laws.

8. Termination

TriStarr may suspend or terminate your account for violations of these Terms, misuse of candidate information, or nonpayment.

9. Intellectual Property

All software, content, and tools provided by TalentSync are the property of TriStarr and may not be copied, reproduced, or used outside the scope of your subscription.

10. Disclaimers and Limitation of Liability

  • TalentSync is provided "as is" without warranties of any kind.
  • TriStarr is not responsible for the performance, conduct, or hiring outcomes of submitted candidates.
  • To the fullest extent permitted by law, TriStarr's liability shall not exceed the fees paid by you in the preceding 3 months.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.

12. Modifications

TriStarr may update these Terms from time to time. Material changes will be communicated via email or dashboard notification.
